These General Conditions of Purchase regulate the use of the andorinart.com website (from now “the website”), which owner is Sergio Cruz, who carries out his activity independently, with registered office at Calle de Los Prados number 21 in Camarma de Esteruelas – 28816 – (Madrid), Spain, with tax identification number 08985945Y, one of his commercial brands being Andorinart. 

The use by the client of the services of the andorinart.com internet shop presupposes, in any case, adherence to the General Conditions of Purchase in the version published by Sergio Cruz at the time of the purchase order. Therefore, the customer should read these General Conditions before making a purchase.

These general conditions will always be subject to the regulations in force at all times. 

In the event of any term or condition modification by the applicable regulation, (whether such modification is temporary or permanent), the customer will have the rights that the applicable regulations recognise. Sergio Cruz will inform the customer of any additional measures that may adopt in its favour.

In the event of a contradiction, between the provisions of the applicable regulations and the provisions of these general conditions, the provisions of the applicable regulations shall apply.

SCOPE OF THE CONTRACT

These General Terms and Conditions of Purchase apply to the sale of all Sergio Cruz articles through its website www.andorinart.com, to consumers to whom orders could be delivered to Europe (Eurozone only). Sergio Cruz informs that his website is exclusively addressed to an audience over 18 years of age. Sergio Cruz reserves the right to cancel a customer’s access account if fraudulent, speculative or, bad faith acts are detected in the use of this service.

PURCHASE LIMIT

For security reasons, purchases of more than 1.500 € or more than 40 items per order cannot be made.

PRICE

The applicable prices are those indicated on the website on the date of the order. The prices are detailed in each article and include V.A.T. (Value Added Tax) as applicable. The amount of the shipping costs will be indicated to the customer at the time of placing the order.

PAYMENT

Payment will be made at the end of the purchase process and will be an essential condition for the formalisation of the purchase. Under no circumstances may payment be made at a later date. Payment by deferred procedures such as cash on delivery or transfer is not permitted. Accepted means of payment: Purchases can be paid for by Visa® or Mastercard® credit card as well as by 4B or 4B Maestro debit card. In any case, the choice of payment method is made during the purchase process on the corresponding screen. The customer must notify Sergio Cruz of any undue or fraudulent charge on the card used for the purchases, by email as soon as possible so that Sergio Cruz can take the appropriate steps. The suppliers or issuers of means of payment may adopt anti-fraud measures that entail the rejection of certain types of transactions. Sergio Cruz is not responsible for the application of this type of security policy.

DELIVERY

The delivery period will be a maximum of 30 calendar days from the date of purchase. Orders will be delivered to the address indicated by the customer according to the following characteristics:

Home delivery:

Free delivery to Spain: by ordinary courier service. Estimated delivery between 3 and 7 working days.

  • Delivery by registered courier service at a cost to the customer. Estimated delivery between 1 and 3 working days.
  • Shipments by ordinary courier service to European Union countries the cost will be to the customer.
  • Shipments by registered courier service at a cost will be to the customer.
  • In the case of shipments to Ceuta and Melilla and the Canary Islands, the customer must also pay the customs duties and taxes generated by the order. These costs are paid at the same time the order is received and, in no case will they be included in the price paid for the products.

The address indicated by the customer may be a home address, a place of work or any other address indicated. It is not necessary for the billing address and the delivery address to coincide. In the case of contracting a registered courier service, a notification will be sent to the user indicating the day on which delivery will be made.

Incidents of delivery: In the case of contracting a registered courier service and not being able to make the delivery due to the absence of the recipient, the transport agency will leave an indicative note.

 

EXCHANGES, RETURNS AND WITHDRAWAL

 

There are different procedures for exchanges, returns and cancellations. To continue, we will describe each of their features, their costs, and their conditions.

 

Exchange: an exchange is considered to be the substitution of the same product in another colour and, or size.

 

Return: due to a defect, fault, receipt of the wrong product, or any other reason other than the above.

 

Withdrawal: return only by decision of the customer.

 

Due to the special features of certain products, the following consideration must be given to:

 

All products that are to be exchanged or returned must have their original packaging and be in perfect condition, except those that are faulty.

 

In case of withdrawal, you will only be liable for the diminished value of the goods when the manipulation is different to the necessary to establish the nature, the features, and the functioning of the goods.

 

EXCHANGES:

 

Conditions: You have one month from the product receipt to make an exchange.

Cost: Exchanges are free of charge for the customer.

 

Procedure: please, contact us via email with the subject: Change order – (your order number) to devoluciones@andorinart.com, and we will pick up the product/s at the delivery address you indicate. In the email, you must include the document attached to the shipment (Form of changes, return and withdrawal), downloadable here, filled.

RETURNS:

 

Conditions: You have one month from the product receipt to return them.

In case of fault: Sergio Cruz will be liable for any lack of conformity that becomes apparent within two years of delivery of the product/s, following the provisions of point 8 of these General Conditions.

Cost: Returns are free of charge for the customer. Sergio Cruz will refund the corresponding quantity without undue delay and, in any case, before 14 calendar days have elapsed from the date, on which it has been informed about the return. The refund will be made by the same means of payment with which it was paid. However, we may withhold the refund until we have received the goods back or until you have provided proof of the return of the goods, whichever condition is met first.

Procedure: An email with the Subject: Return order – (your order number) to devoluciones@andorinart.com, and we will collect the product(s) from the delivery address you provide. In the email, you must include the document attached to the shipment (Form of changes, return and withdrawal), downloadable here, filled.

 

RIGHT OF WITHDRAWAL:

 

Conditions: you have the right to withdraw from the contract without justification within 14 calendar days from receipt of the product.

 

Cost: The withdrawal is free of charge for the customer. Sergio Cruz will refund the corresponding quantity without undue delay and, in any case, before 14 calendar days have elapsed from the date, on which you have been informed of the withdrawal decision. The refund shall be made by the same means of payment with which it was paid. 

However, we may withhold the refund until we have received the goods back or until you have provided proof of the goods return, whichever condition is met first.

 

Procedure: Send an email with the Subject: Withdrawal order – (your order number) to devoluciones@andorinart.com, and we will collect the product/s at the delivery address you indicate. In the email, you must include the document attached to the shipment (Form of changes, return and withdrawal), downloadable here, filled.

 

 

PRODUCT AVAILABILITY

 

If there are any incidents in terms of supply or there are no products in stock, the customer will be informed, immediately. The quantity of the product, or products, out of stock, will be refunded. Sergio Cruz will refund the corresponding quantity without undue delay and, in any case, within 14 calendar days. The refund will be made by the same means of payment with which it was paid. The stock availability data in the physical shop shown on our website are approximate and may vary.

 

GUARANTEE OF THE PRODUCTS PURCHASED

 

The guarantee offered is established in the Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users. Sergio Cruz will be liable for any lack of conformity within two years of delivery.

Andorinart® Customer Service will attend and respond to your complaint as soon as possible, and in any case within a maximum period of one month. If it has not satisfactorily resolved your request, you may go to the ordinary courts or process your claim through the website http://ec.europa.eu/odr, which will provide a single point of access for out-of-court settlement free of charge.

 

MODIFICATION OF THE GENERAL CONDITIONS OF PURCHASE.

 

Andorinart® reserves the right to modify these General Conditions of Purchase at any time. No modification will affect orders already in progress.

 

FORCE MAJEURE.

 

Andorinart® shall suspend the fulfilment of all or part of its obligations in the event of a fortuitous event or force majeure preventing or delaying this fulfilment. 

 

The following shall be considered as such, in particular, without this list being exhaustive: 

war, pandemic, riot, insurrection, social unrest, strikes of any nature and supply problems not attributable to Andorinart®. Andorinart® shall inform the customer of any such fortuitous event or force majeure within seven days of its occurrence. If this suspension lasts longer than fifteen days, the customer will have then the possibility to cancel the order in progress. It will be refunded, under the conditions set out in point 6 of the present General Conditions of Purchase or those others where the applicable regulations may, where appropriate, establish.

 

APPLICABLE LAW AND JURISDICTION

 

These General Conditions of Purchase are subject to Spanish law. Without prejudice to the foregoing, consumers who are not residents in Spain also enjoy the protection guaranteed by the mandatory provisions of the law of the country where they have their habitual residence. All the parts submit, at their choice, to the courts and tribunals of the customer’s domicile for the resolution of conflicts and renouncing any other jurisdiction.
